1. ORDERING PRODUCTS

Immediately after you have placed your order on TO-BE.com and paid with your credit card, we will send a payment receipt to your email address. After this, we will process your order and forward an order confirmation to you. Once you have received the order confirmation, you enter into a binding agreement about purchase of the product.

 

We strive to ensure that the information on our website and on your order confirmation is always accurate. However, errors may occur, and consequently we reserve our position on misstated prices, typing errors, availability of products, suspicion of fraud and also force majeure. In such cases, we reserve the right to cancel the agreement partly or totally. Yet, we will always endeavour to solve the challenge in the best possible way to your advantage.

2. TERMS OF PAYMENT

At TO-BE.com, we accept the following credit cards:

·        MasterCard (0%)

 

The payment is debited from your card at time of dispatch. It is not possible for TO-BE Continued A/S to withdraw a larger amount than the one that has been validated by you.

 

The dispatch costs are added to your order. See our dispatch costs under the menu option Shipping.

 

Danish VAT of 25% will be applied to orders dispatched to countries within the European Union.

 

When the order is dispatched to countries outside the European Union, the product may be applied VAT, import duties or other duties. We deliver the product on the basis of INCOTERMS Delivered Duty Unpaid (DDU), which means that we do not charge VAT, duties or fees when products are sold to countries outside the European Union. We are not familiar with the additional VAT, dutiesor fee costs that may be applied to the product. We refer to the local authorities in the country in question to which the product is to be delivered.

 

The payment is processed using Epay A/S and NETS, entailing that all information that is sent to us over the internet in connection with the purchase is secured and encrypted. Only you as a customer and NETS as the credit card acquirerare able to see your credit card information. The payment system complies with the prevailing standards and regulations.

3. DELIVERY

The product will be sent within 1-3 weekday(s) after receipt of your order confirmation. Products are dispatched every weekday, and we make an effort to send the product on the same day as receipt of the order. However, we reserve our position on products that are sold out.

 

We arrange for delivery with GLS and UPS or another freight company. TO BE Continued cannot be held responsible for delays caused by the employed freight companies.

 

Ordered products must be collected from GLS, UPS or another freight company within the time limit informed. If the product is not collected timely, it will automatically be returned to us. Costs on return dispatch from the freight carrier to us will be collected from you. This applies in connection with cases, where we have to re-forward your products and if you regret your purchase, respectively.

4. RIGHT OF CANCELLATION

All purchases made in this web shop is covered by a 14-day right of cancellation. You have 14 days to inform us that you want to cancel the purchase, and from this date, you have 14 days to return the item to us. The right to return comes into force from the day you, or a person chosen by you, receive(s) the product. If you cancel a purchase, you must return the product in the same condition as on delivery and in its original packaging.

 

You have the right to cancel a purchase even if the item has been taken into use. An item is only considered used if it has been handled more than what is possible when trying it out in a physical store. If you have taken the item into use, a precise assessment must be made of what the item can sell at to another consumer in its used condition. In case of a possible decrease in value, the reimbursement can be reduced in relation to the decrease in the product value.

If you cancel the purchase of a product, you will have to pay the costs for freight in connection with returning the product yourself. We do not accept packages sent to us cash on delivery (COD).

You are responsible for the product until we receive it on our address. You must ensure that the product is packaged securely in the same way as when you received it from us. We recommend that the package is shipped using Track and Trace so that you are able to prove that the product has been returned to us.

 

Once we receive the product in our warehouse, the purchase price of the product will be refunded within few days. The refund will be made to the same card used in connection with the purchase unless you inform us otherwise.

 

Provided that the product is not returned in the same condition or in its original packaging, it must be expected that the reimbursement is reduced in relation to the decrease in the product value. Decrease in product value may for example occur if the product is damaged in your custody.

5. RIGHT TO CLAIM COMPENSATION

Trade on our website is covered by the Danish Sale of Goods Act, including the regulations about defects in the purchased product. As a customer, you can complain about faults and defects for a period of 24 months after the purchase. Depending on the concrete situation, you have the right to get a defective product fixed or exchanged, and in certain situations get your money refunded or be granted a reduction on the price.

 

The complaint must be legitimate, and therefore the right to claim compensation does not cover faults and damages occurring as a consequence of misuse, neglect of maintenance or ordinary wear and tear. You must complain within reasonable time, and we recommend that you complain immediately after discovering faults in the purchased product.

 

At TO BE Continued A/S, we make an effort to deliver products of high quality. Nevertheless, if you were to receive a defective product, you should contact support@to-be.com. In order to deal with your complaint in the best possible way and as fast as possible, we need picture documentation and a description of the discovered fault in the product. We will subsequently evaluate your complaint after which you will be contacted by us.

 

In some instances, we will inquire you to return the defective product to us with regard to further increasing the quality assurance at our suppliers. If inquired, your freight costs will be refunded by us.

 

You have the responsibility for the product until we receive it at our address. Therefore, you must ensure that the product is securely packaged. We recommend that the package is sent to us using Track and Trace, so that you are able to prove that it has been returned to us.

6. PROTECTION OF PERSON DATA

If you wish to shop on TO-BE-com, we need the following information about you:

We need to register this information in order to be able to deliver the product to you and to provide you with the best possible purchase experience. No personal information registered at TO BE Continued A/S as data manager will be handed over or made available to a third party. All information is safely stored.

 

Under the terms of the Danish Data Protection Act, TO BE Continued A/S as administrator of TO-BE.com is obligated to protect your personal information. All information is treated in accordance with the applicable law. The only data collected and shared with a third party is concerned with customer traffic or commercial information. Sharing of information will strictly take place for the purpose of optimizing your experience on our website.
